Pomita; fyi this is the California law: a rape is committed (among other circumstances) when "a person is prevented from resisting (sex) by any intoxicating, narcotic or anesthetic substance. .

  It doesn't say how much either, it is oh so grey. Given a certain amount of sexism this law will be applied 9 times out of ten to men who have sex with drunk women. So yeah Raj would know about this for sure, he's at a university and this coming week the episode is about sexual harassment. So the writers have made Raj both stupid and guilty.

I never re-watch this episode.  Do you think it meant the burden for attempted rape or do you think it left it vague enough to sell us that it was legally consensual?  I am sure they never intended to have him rape her but even if they did it accidentally it is even less cool.  My brain didn't jump to rape because I would never ever do anything like that with an intoxicated female even if I had her consent beforehand. You just don't do that.

thats the thing is they don't really get enough info to say either way.  All we know is that we see Penny and Raj talking, her saying that if she normally would have sex with someone in the state she was in but she DIDN'T want too with Raj because of all the friendships and everything.  Then next scene of them is the two of them waking up together.  She was clearly pretty damn drunk if she remembers none of it, but who is to say what happened?  We got Raj's side of things since he could remember apparently but who's to say thats the truth?  I'm certainly not accusing him of rape I'm jsut saying the cracks in the floor are there.

I watch it for Leonard's hurt look, Penny's evident distress because she knows something bad happened, Raj's table setting skills, the flag hoist by Prya, Howard's pretty thing and of course the brilliant and clueless Dr Sheldon Lee Cooper BS, MS, MA, PhD, and ScD asking that big question "What's it look like?". It's more than 90% funny, and unforgettable. And also what the creatives intended. It's part of the whole cloth of the show. The pain and the pleasure. Just my opinion. A great topic that will never die.
