Real people can be rather inconsistent at times too.

Yeah, but it's inconsistency in the things that shouldn't be inconsistent. For instance, Penny was 21 at the start of the series, she just moved out after living with Kurt for four years. If we allow that she graduated from high school, at 17 (her birthday is Nov 30, and some school districts allow those who are four to start school at four, as long as they turn 5 by December first). Then she said she dropped out of college, which would have to be almost the same day she started. That has be the case to enable her to get to LA, find Kurt, and move in with him to live with him for four years. If you don't give her starting school at four, it's simply not possible. There are other things, exactly when the elevator was broken (or alternatively, when did all the guys meet), Sheldon said he had time to plan a trip to be out of the apartment when Leonard had sex, yet, Sheldon is shown interrupting Leonard and Joyce Kim. The fact that Penny's apartment has to be hanging over the street among others.

It is also interesting that they always walk down the stairs but you never see the people above them come down the stairs, especially when they are running back and forth in their go to sleep wear.

Yes, the building seems to be vacant except for s3e23 when Mrs. Gunderson appears outside her door...

'Good morning, Leonard. Or should I say "yee-haw"?'

Im saying nothing till the episode seeing as we know he hugs her back

I think the taping report said that he finally pats her with one hand.  I wonder if it's anything like the reluctant hug he tolerated from his sister.  That was pretty awkward, too.
