The show's writers have had several opportunities to do so and have squandered them. If it were me, I would think Penny's maiden name would be something Scandinavian since she's from the Midwest. Like during a wedding scene when saying her name someone sneezes really loudly or during another scene Beverly gets annoyed and interrupts her before she says it. I recall an interview with Chuck Lorre and Steve Molaro where they were saying maybe this is what they would do. Chuck was speculating that maybe the name would be something really common, such as Jones. So, in my head, she has been Penny Jones, although Penny Johnson would capture the Scandinavian aspect. Here in the states, it's not automatic that one participant takes the other's name. People have to legally change their names after marriage. It's highly unlikely she did the paperwork to make her name Johnson, since she would have to have thought she was in a valid marriage, then take the license to the various entities (Driver's License, Social Security, etc) and actually change it.
