It should say what happens to the assets in case of a divorce...I can't speak to exact US laws as I'm in Canada, but in divorce here assets and support are two different issues. Assets is property division and no doubt would be covered in a pre-nup. Support payments, however, are grounded differently from a legal perspective, based on the roles in the marriage, the length of the marriage, the effect in each party of the marriage breakdown, etc. I don't know if support was explicitly noted in the pre-nup, and even if it was, depending how a marriage played out a judge could see reason to override it I would think (such as in a long marriage where one party is now ill and unable to work FT, and hence in need of support). Not that any of these conditions apply easily here--short marriage, no kids (he wasn't a house hubby), his tennis career may be done but surely there are countless other ways he could find employment. But from a legal perspective, a pre-nup may have only addressed assets/property, and not support (which is determined by income, not assets). Many people mistake Lust for Love. Are we not attracted to Kaley because of her brazen sexuality and beauty? Is she not human and sexually attracted to tall masculine men? He, on the other hand, most times looked bored and/ or faking it. I chalked it up to discomfort each time. Was it the PC awards where he didn't come and Kaley won? At first they were all smiles, then after a while his smile looked strained, until this year when they looked forced or he didn't smile at all. However, we don't know if his request for support payments is more than what is specified. What we do know is he is asking or Kaley to pay for the lawyers for both of them, along with his specifying a different date of seperation. Both are in conflict with Kaley's petition. I'm sure Ryan will get some kind of spousal support, since it is reportedly specified in the pre-nup, according to her petition. Since he is trying to get her to pay for his lawyers, which according to her petition specifies they each pay their own, it appears it's going to be more about whether Ryan is going to adhere to the pre-nup or not. If he gets the pre-nup thrown out, then he can ask for much more. It doesn't appear, from those articles, that he has much chance of getting it thrown out. He may get some sympathy for his injuries, but his net worth will hurt him in court. Spousal support is supposed to be for those who have no means of supporting themselves to transition to the point of being able to support themselves. With his net worth, it's tough to see how he can't support himself. Even if he manages to get it, normal length of spousal support, in California, is half the period of the marriage. If it really comes to the point where the judge throws out the prenup, she should offer him a one-time sum of money, a take it or leave it kind of thing. Also, I think he's not broke. I've also seen estimates of Kaley's net worth that vary quite a bit ever since she was named one of the highest paid women on TV. So if you look at extremes, Kaley could be very wealthy and he could be broke, hurt, his career basically over and now has pain pill problem, so this divorce will be like throwing him out on the street.
