I wonder what legal basis he has for seeking spousal support. Isn't that the reason they filed a prenup? It should say what happens to the assets in case of a divorce...

I can't speak to exact US laws as I'm in Canada, but in divorce here assets and support are two different issues. Assets is property division and no doubt would be covered in a pre-nup. Support payments, however, are grounded differently from a legal perspective, based on the roles in the marriage, the length of the marriage, the effect in each party of the marriage breakdown, etc. I don't know if support was explicitly noted in the pre-nup, and even if it was, depending how a marriage played out a judge could see reason to override it I would think (such as in a long marriage where one party is now ill and unable to work FT, and hence in need of support). Not that any of these conditions apply easily here--short marriage, no kids (he wasn't a house hubby), his tennis career may be done but surely there are countless other ways he could find employment. But from a legal perspective, a pre-nup may have only addressed assets/property, and not support (which is determined by income, not assets).

Way out of line.  Mean-spirited.  And yes, a little harsh to say the least.

 

 

Maybe a little harsh but Not so mean as factual. Many people mistake Lust for Love. Are we not attracted to Kaley because of her brazen sexuality and beauty? Is she not human and sexually attracted to tall masculine men?  At her age, she is just reaching her sexual peak. I do not think my statement is out of line.

Something I had always noticed in pictures was she looked so happy in all of them, events and selfies. He, on the other hand, most times looked bored and/ or faking it. I chalked it up to discomfort each time. Was it the PC awards where he didn't come and Kaley won? I just hope she can get that Ryan bug squashed ASAP so she can move on with her life. I'm glad I'm not the only one that noticed that.  At first they were all smiles, then after a while his smile looked strained, until this year when they looked forced or he didn't smile at all.  She stopped really smiling towards the end too or when she did smile you could see it was not the same a before.

Kaley's petition specified that spousal support was payable, so his asking for it is nothing more than what he needs to do in his petition to get what is specified.  However,  we don't know if his request for support payments is more than what is specified.  What we do know is he is asking or Kaley to pay for the lawyers for both of them, along with his specifying a different date of seperation.  Both are in conflict with Kaley's petition.

Sorry, I think your choice of that one word was harsh. You could have referred to his "manly physique" or that he is a "handsome specimen". The other word (for me) is over the line. Sent from my iPhone using Tapatalk

Sorry But this isn't the 1950s where Rock Hudson and Doris Day Have separate beds as Man & Wife in a Movie.  Ever movie these days has the "F" word used multiply times. Sorry but the word I used is an exceptable MEDICAL TERM. Maybe it is time to throw all the Political Correctness out the window. When I was a kid we called each other names like Dago, Chink, Nip, Pole Lock, Hunnie, Wap and Mackerel Smacker just to name a few. NO ONE got excited about it.

To be honest, I've always blamed Henry Cavill for the whole marriage.  No matter what the reason they got together was, I think Mr. Ladies Man Cavill used her and hurt her.  Everything afterwards was classic rebound relationship stuff.

yeah I saw that, but I also read that he hurt himself again while married to her and that is when he got the pain pills.  If he gets a doctor to tell the court he was hurt while married and because of his injury his tennis career is over, they might have considerable sympathy for him.

wasent he rehabing when they married from an injury, I guess he could claim he made it worse in the one tournament I think k he played in after the weddung

It's just a judge.  I'm sure Ryan will get some kind of spousal support, since it is reportedly specified in the pre-nup, according to her petition. Since he is trying to get her to pay for his lawyers, which according to her petition specifies they each pay their own, it appears it's going to be more about whether Ryan is going to adhere to the pre-nup or not.  If he gets the pre-nup thrown out, then he can ask for much more.  It doesn't appear, from those articles, that he has much chance of getting it thrown out.  

He may get some sympathy for his injuries, but his net worth will hurt him in court.  Spousal support is supposed to be for those who have no means of supporting themselves  to transition to the point of being able to support themselves.  With his net worth, it's tough to see how he can't support himself.   Even if he manages to get it, normal length of spousal support, in California, is half the period of the marriage.  That would be less than a year.

I wonder if Kaley owns the house solely, cos with Ryan's alleged $2 millions I doubt he would be able to contribute much to it, the house looks expensive!

That doesn't mean she's responsible for his injury or his pain med addiction, so why should she pay for it. If it really comes to the point where the judge throws out the prenup, she should offer him a one-time sum of money, a take it or leave it kind of thing.

Also, I think he's not broke. I read somewhere his own net worth is somewhere around $2 million, so he could have a hard time convincing a judge why he needs more money on a regular basis

This net worth thing seems vary on who is reporting it.  I've seen a couple sites state that it is the amount of money he has earned since he went pro and if that is the case, it could all be gone now.  I've also seen estimates of Kaley's net worth that vary quite a bit ever since she was named one of the highest paid women on TV.  So if you look at extremes, Kaley could be very wealthy and he could be broke, hurt, his career basically over and now has pain pill problem, so this divorce will be like throwing him out on the street.  I just don't see the court doing that.

Maybe Kaley would do better to simply pay him off,. Give him enough to get him back on his feet, perhaps to start up a tennis coaching school so he has a source of income. It would be a fair offer on her part under the circumstances and would allow them both to get on with their lives and move on. Sent from my iPhone using Tapatalk

Pain Med is more than likely the reason for the Divorce. Pain Pills don't make you a good partner.

Not the pain pills themselves since practically everbody on earth from a certain age has taken some in his/her life. But the addiction to them is surely a large factor. Also, he surely was pissed about his non-existent career and that doesn't make a happy hubby.
